NOTICE OF INTRODUCTION
TOWNSHIP OF ELK
TAKE NOTICE that the following Ordinance was passed on first reading by the Township Committee of the Township of Elk at a meeting held on March 7, 2024, and that said ordinance will be further considered for final passage and adoption at a meeting to be held on April 4, 2024, at 7:00pm at the Elk Township Municipal Building, 680 Whig Lane, Monroeville, NJ 08343, at which time any person interested therein will be given the opportunity to be heard.
A full and complete copy of ordinances can be obtained without cost by any member of the general public in the office of the Municipal Clerk and a copy is posted in the Municipal Building.
ORDINANCE O – 1 – 2024
ORDINANCE ADOPTING AN AMENDED REDEVELOPMENT PLAN FOR BLOCK 31, LOTS 2.02, 5.01, 7 AND 22; BLOCK 32, LOT 1 AND BLOCK 58, LOT 1 (AURA III) WITHIN THE TOWNSHIP OF ELK, COUNTY OF GLOUCESTER, STATE OF, STATE OF NEW JERSEY
WHEREAS, in order to facilitate the development, redevelopment, and rehabilitation of the Township of Elk (the “Township”), the Mayor and Committee of the Township of Elk (the “Township Committee”), designated certain property identified on the Township’s Official Tax Map as Block 31, Lots 2.02, 5.01, 7 and 22; Block 32, Lot 1 and Block 58, Lot 1 as a Non-Condemnation Redevelopment Area (the “Redevelopment Area”) pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq., (the “Redevelopment Law”) (the “Property”); and
WHEREAS, pursuant to N.J.S.A. 40A:12A-7, the Township Committee may adopt, revise, or amend a
redevelopment plan with respect to a designated area in need of redevelopment or rehabilitation; and
WHEREAS, the Elk Township Committee adopted the Aura III Redevelopment Plan on June 4, 2020, via Ordinance No. O-2-2020; and
WHEREAS, the Elk Township Committee has determined to prepare an amended Aura III Redevelopment Plan, attached hereto, and identified as “Amended Aura III Redevelopment Plan dated February 2024”; and
WHEREAS, the Amended Redevelopment Plan provides a broad overview for the planning, development,
redevelopment and rehabilitation of the Redevelopment Area for purposes of improving conditions within the Township; and
WHEREAS, the Township Committee has determined that it is in the best interest of the Township to adopt the Amended Redevelopment Plan to effectuate redevelopment and rehabilitation within the Township and specifically Block 31, Lots 2.02, 5.01, 7 and 22; Block 32, Lot 1 and Block 58, Lot 1; and
WHEREAS, pursuant to N.J.S.A. 40A:12A-7, on February 20, 2024, the Township Committee adopted a Resolution referring the attached Amended Redevelopment Plan to the Combined Planning and Zoning Board of the Township of Elk (the“Combined Planning and Zoning Board”) for review and approval following introduction and first reading; and
WHEREAS, the Combined Planning and Zoning Board adopted a Resolution recommending the Township
Committee adopt the Amended Redevelopment Plan; and
WHEREAS, the Township Committee has reviewed and accepted the recommendations of the Combined Planning and Zoning Board and determined it to be in the best interest of the Township to adopt the Amended Redevelopment Plan to effectuate redevelopment and rehabilitation within the Township and specifically Block 31, Lots 2.02, 5.01, 7 and 22; Block 32, Lot 1 and Block 58, Lot 1; and
NOW THEREFORE BE IT ORDAINED by the Mayor and Committee of the Township of Elk as follows:
Section 1. The aforementioned recitals are incorporated herein as though fully set forth at length.
Section 2. The Township Committee declares and determines that said Amended Redevelopment Plan meets the criteria, guidelines, and conditions set forth in N.J.S.A. 40A:12A-7, provides realistic opportunities for the development and rehabilitation of the Township and specifically the Redevelopment Area, and is otherwise in conformance with N.J.S.A.40A:12A-1 et seq. Section 3. The Township Committee hereby accepts the recommendations of the Combined Planning and Zoning Board and adopts the attached Amended Redevelopment Plan entitled “Amended Aura III Redevelopment Plan February 2024”, for the Township of Elk and specifically Block 31, Lots 2.02, 5.01, 7 and 22 Block 32, Lot 1 and Block 58,
Lot 1. Section 4. The Township Committee of the Township of Elk shall have, be entitled to, and is hereby vested all power and authority granted by the aforementioned statutory provisions to effectuate the Amended Redevelopment Plan.
Section 5. The Amended Redevelopment Plan shall constitute an overlay zone to the extent set forth therein.
Section 6. All ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency.
Section 7. In the event any clause section or paragraph of this Ordinance is deemed invalid or unenforceable for any reason, it is the intent of the Township Committee that the balance of this Ordinance remains in full force and effect to the extent it allows the Township to meet the goals of the Ordinance.
Section 8. This Ordinance shall take effect immediately after final adoption and publication according to law.
