Notice of Pending Ordinance and Summary
ORDINANCE 25-2026
The ordinance, the summary terms of which are included herein, was introduced and passed
upon first reading at a meeting of the Mayor and Borough Council of the Borough of Clayton, in
the County of Gloucester, State of New Jersey, on September 24, 2026. It will be further
considered for final passage, after public hearing thereon, at a meeting of the Mayor and Borough
Council to be held at the Clayton Borough Municipal Building, 125 North Delsea Drive, Clayton,
New Jersey, on October 8, 2026 at 6:00 o’clock PM. During the week prior to and up to and
including the date of such meeting copies of the full ordinance will be available at no cost and
during regular business hours, at the Borough Clerk’s office for the members of the general public
who shall request the same. The summary of the terms of such ordinance follows:
Title: AN ORDINANCE TO AMEND THE CODE OF THE
BOROUGH OF CLAYTON BY REPEALING AND
REPLACING CHAPTER 31A AFFORDABLE HOUSING
The purpose of this ordinance entitled “An Ordinance to Amend the Code ofthe Borough of Clayton
by Repealing and Replacing Chapter 31A Affordable Housing” is to update the Borough’s standards
for the collection, maintenance and expenditure of development fees that are consistent with the
regulations in the Fair Housing Act as amended in 2024 (N.J.S.A. 52:27D-301 et seq.), N.J.A.С.
5:99-1 et seq., and as previously established in P.L. 2008, c. 46, Sections 8 and 32 through 38
(N.J.S.A. 52:27D-329.2), and the Statewide Nonresidential Development Fee Act (N.J.S.A. 40:55D8.1 through 8.7). The second purpose of the Ordinance is to update the Borough wide standards and
regulations that govern the development of very low, low, and moderate income affordable units for
multifamily for-sale and rental residential developments that may be approved by the Borough or
the Borough Planning Board in accordance with the Fair Housing Act, as amended, Uniform
Housing Affordability Controls, N.J.A.C. 5:99-1 et seq., and applicable New Jersey Council on
Affordable Housing regulations.
