EIGHT YEARS NJSP IN FRANKLIN TWP SEX ASSAULT

Kenny Sotomayor age 52, of Vineland, was sentenced on Friday, March 17th to eight years in New Jersey state prison after pleading guilty to sexually assaulting a girl under age 13 in Franklin Township in January 2008. Sotomayor pleaded guilty on 9/12/16 to one count of second-degree sexual assault of a child under age 13 by a defendant at least four years older than the victim.

Upon release from prison, Sotomayor will be required to register as a sex offender under Megan’s Law and comply with its reporting conditions, and he also will be subject to at least fifteen years of parole supervision.  He must serve 85 percent of his eight-year prison term before he is eligible for parole. Sotomayor has been in jail in default of bail since his arrest 3/19/15.  The victim made disclosures about him when she was 12 years old, dating back seven years.

Sotomayor was evaluated at the state’s Adult Diagnostic and Treatment Center, a facility for sex offenders in Avenel NJ, and found to be a repetitive sex offender, but was not classified as compulsive, said sentencing Superior Court Judge Kevin T. Smith. He is therefore not a candidate for treatment at the Avenel center, but should receive counseling or therapy to prevent repeat offenses, the judge said.
