WHEREAS, the Local Public Contracts Law (N.J.S.A.40A:11-1 et seq.) requires the governing body of a
contracting unit to publish a notice in a newspaper authorized by law to publish its legal advertisements,
setting for the nature, duration, service and amount of the contract where such contract is awarded for
“professional services” without competitive bidding;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Clayton, County
of Gloucester, and State of New Jersey as follows:
- That Timothy D. Scaffidi, Esquire, of Woodbury, New Jersey, is hereby appointed as Solicitor for
the Borough of Clayton for the year 2026.
2. That Bowman & Company LLP of Voorhees, New Jersey, is hereby appointed as Auditor for the
Borough of Clayton for the year 2026.
3. That Mark Brunermer P.E. of Sickels & Associates, Inc., of Woodbury, New Jersey, is hereby
appointed as the Municipal Engineer and Municipal Water/Sewer Engineer for the Borough of
Clayton for the year 2026.
4. That Hardenbergh Insurance Group, of Voorhees, New Jersey, is hereby appointed as Insurance
Broker for the Borough of Clayton for the year 2026 and as the Risk Management Consultant
pursuant to N.J.S.A.:11-5(1)(a)m) for the year 2026.
5. That Parker McCay, of Mount Laurel, New Jersey, is hereby appointed as Bond Counsel for the
Borough of Clayton for the year 2026.
6. That David Robinson of Synergy Environmental, of Cherry Hill, New Jersey, is hereby appointed
as Environmental Engineer/LSRP for the Borough of Clayton for the year 2026.
7.That Brown & Connery, of Westmont, New Jersey, is hereby appointed as Labor Attorney for the
Borough of Clayton for the year 2026.
8. That Parker McCay, of Mount Laurel, New Jersey, is hereby appointed as Redevelopment
Counsel and Redevelopment Consultant for the Borough of Clayton for the year 2026.
9. That Gary Marek, Esquire, of Mount Laurel, New Jersey and Eric Riso, Esquire, of Cherry Hill,
New Jersey, is hereby appointed as Special/Conflict Solicitor for the Borough of Clayton for the
year 2026.
10. That Sickels & Associations of Woodbury, New Jersey, is hereby appointed as, Special Projects
Engineer for the Borough of Clayton for the year 2026.
11. That Archer & Greiner of Haddonfield, New Jersey is hereby appointed as Environmental Counsel
for the Borough of Clayton for the year 2026.
12. That Phoenix Advisors of Bordentown, New Jersey is hereby appointed for Continuing Disclosure
Services for the Borough of Clayton for the year 2026.
13.That Bryson & Yates of Sewell, New Jersey is hereby appointed as ADA Compliance Engineer
for the Borough of Clayton for the year 2026.
14. That JF McKernan Architects of Cherry Hill, New Jersey is hereby appointed as Architect for the
Borough of Clayton for the year 2026.
15.That Gary Marek, Esquire of Mount Laurel, New Jersey is hereby appointed as Special OPRA Counsel for the Borough of Clayton for the year 2026.
16. That TRIAD Associates, of Vineland, New Jersey is hereby appointed as Grant Consultant and Administration Agent for Affordable Housing for the Borough of Clayton for the year 2026.
17.That the appropriate officers of the Borough of Clayton are hereby authorized to enter into a contract with said professionals.
18. These contracts are awarded without competitive bidding as a “professional service” under the provision of the Local Public Contracts Law because the specialized training, education, experience and specialized knowledge needed for this position cannot be properly described in specifications which would have to be prepared for competitive bidding and because the law permits agreements for professional services without public advertising and bidding therefore and pursuant to the Fair and Open Process.
19. A notice of the award of these contracts shall forthwith be printed once in The Sentinel, the official newspaper of the Borough of Clayton, authorized by law to publish the legal advertisements of the Borough of Clayton, and further stating that this resolution and the annexed contract are on file and available for public inspection in the Office of the Clerk of the Borough of Clayton.
